Malpractice & Physician Apologies
Host: Barbara Lewis
Interview: Wendy Levinson, MD
Professor of Medicine and Chair
Department of Medicine
University of Toronto, Ontario
One of the bills passed by both houses of the Indiana General Assembly this year would protect doctors who choose to say "I’m sorry," from having their apology used against them in a malpractice claim. Currently, more than a dozen states have versions of this legal protection.
It’s part of a growing "Say You're Sorry" movement, which has arisen as one way of dealing with malpractice lawsuits and rising insurance rates. The notion is that patients who file a malpractice claim sometimes just want the doctor to take responsibility for what went wrong.
Today we meet Wendy Levinson, MD. Dr. Levinson is a professor of medicine at the University of Toronto and has consulted across the country on this topic.
